Real estate legal services

Many property issues only become apparent when you want to sell, renovate, finance or inherit. Perhaps the documentation turns out to be incomplete. Perhaps you discover during a purchase that an extension was never properly registered. Or you find out years later that the Cadastre, the Land Registry and the actual situation do not match.

We assist international property owners on the Costa Tropical with legal and administrative property matters: from AFO procedures to georeferencing, from inheritances to missing square metres in the Land Registry. Every situation is different and requires an individual assessment.

AFO procedures and legalisations

Many properties in Andalusia were built or extended when planning rules were applied differently than today. As a result, a home often does not fully correspond with its official documentation.

Depending on the circumstances, an AFO can clarify the legal status of a property and simplify future transactions.

Georeferencing

Boundaries look straightforward, but in practice we regularly find discrepancies between the Cadastre, the Land Registry and the situation on site.

Georeferencing establishes the exact location of a plot and often plays a role in sales, inheritances, registry amendments and other procedures.

Cadastre and Land Registry

Many owners assume the Cadastre and the Land Registry hold identical information. Often they do not: missing square metres, different surface areas, discrepancies between the physical property and the records.

These differences cause problems when selling, financing, inheriting or legalising. We analyse the discrepancies and find the appropriate solution.

Declaración de Obra Nueva Antigua

Many homes on the Costa Tropical have been extended or modified without the changes being recorded in the Land Registry: pools, garages, storage rooms, covered terraces, extensions.

A Declaración de Obra Nueva Antigua can in many cases register the existing situation. It frequently matters in sales, financing and inheritances.

First registration (inmatriculación)

Not all properties and plots are in the Land Registry. We regularly encounter property that physically exists but has never been officially registered.

Without proper registration there are difficulties when selling, financing, gifting or inheriting. An inmatriculación registers a home or plot for the first time; we assess the options and gather the documentation.

Inheritances

An inheritance in Spain involves more than signing a deed. Inheritance tax, acceptance of the estate, registration of ownership and the possible sale of inherited property are all part of the process.

We guide heirs through the legal and administrative procedure and map out the next steps.

Regularisations

Sometimes it only becomes apparent years later that information is missing or incorrectly recorded: surface areas, descriptions, registrations or other inconsistencies that surface when a property is sold, financed or inherited.

We identify these situations and regularise them where possible.

Aftersales for buyers and sellers

A property transaction does not end at the notary. For buyers we handle the declaration and payment of Transfer Tax (ITP), tax obligations such as Modelo 211 and the transfer of water, electricity and other utilities. For sellers, the Plusvalía Municipal and other obligations arising from the sale.

Aftersales services are available from €500 excl. VAT for buyers and from €150 excl. VAT for sellers.
